Tiffany Haddish’s 2022 DUI case will move forward after a Georgia judge rejected her request to dismiss the charges. The actress and comedian is now set to face trial after the court ruled that the delay in the case did not violate her right to a speedy trial.
Fayette County Judge Jason B. Thompson denied Haddish’s defense team’s motion to have the charges dismissed, according to CBS News.
The case stems from her January 2022 arrest in Peachtree City after police received a report about a driver who appeared to be asleep behind the wheel. An officer reportedly found a vehicle that matched the description from the call and stopped Haddish as she pulled into the yard of a residence.
Police then arrested her and charged her with driving under the influence, failure to obey a traffic control device, improper stopping on a roadway, and a parking violation.
Haddish later posted bond and was released from the Fayette County Jail. Her attorneys argued that the time between her arrest and a possible trial violated her constitutional right to a speedy trial and asked the court to dismiss the case.
Judge Thompson disagreed with the defense’s argument, saying Haddish did not raise her speedy trial claim soon enough. He also ruled that there was no evidence showing the delay seriously affected her ability to defend herself.
The judge noted that Haddish was not held in custody during the delay and said claims of stress, concern, or possible fading memories were not enough to prove actual prejudice. He also found no evidence that the delay caused witnesses to be lost, evidence to be destroyed, or other damage to the defense.
With the dismissal request denied, Haddish’s DUI case is scheduled to go to trial on August 13.
